1. Acceptance of Terms
These Terms of Service ("Terms," "Agreement") constitute a legally binding agreement between you ("User," "Customer," "you," or "your") and Dewey's Pizza ("we," "us," "our," or "Company"), governing your access to and use of the website located at pizzadeweys-eat.rest (the "Site"), including any content, functionality, services, and products offered on or through the Site.
By visiting our Site, creating an account, placing an order, subscribing to any promotional communications, or otherwise engaging with our digital or in-person services, you expressly agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference. If you are using this Site on behalf of an organization, corporation, or other legal entity, you represent and warrant that you have the authority to bind that entity to these Terms, and references to "you" shall include both you and that entity.

Users between the ages of 13 and 17 may use this Site only with verifiable parental or guardian consent. We do not knowingly collect personal information from children under the age of 13 in accordance with the Children's Online Privacy Protection Act (COPPA).

2. Description of Services
Dewey's Pizza is a food service establishment offering the following products and services (collectively, the "Services"):

4. User Obligations and Prohibited Activities
As a condition of your use of the Site and Services, you agree to comply with all applicable federal, state, and local laws and regulations. You further agree that you will not engage in any of the following prohibited activities:
4.1 General Prohibited Conduct
- Using the Site for any unlawful purpose or in violation of any applicable local, state, national, or international law or regulation;
- Impersonating any person or entity, or falsely stating or misrepresenting your affiliation with a person or entity;
- Engaging in fraudulent activity, including submitting false or misleading orders, chargebacks, or refund requests;
- Harassing, threatening, intimidating, or harming other users, our employees, or any third party;
- Collecting or harvesting any personally identifiable information from the Site;
- Using the Site to send unsolicited communications (spam);
- Interfering with or disrupting the integrity or performance of the Site or its related systems.
4.2 Technical Prohibited Conduct
- Attempting to gain unauthorized access to any portion or feature of the Site, or any other systems or networks connected to the Site;
- Using any robot, spider, crawler, scraper, or other automated means to access the Site for any purpose without our express written permission;
- Attempting to decipher, decompile, disassemble, or reverse engineer any of the software comprising or making up the Site;
- Uploading, transmitting, or distributing any computer virus, worm, or any software intended to damage or alter a computer system or data;
- Using any device, software, or routine that interferes with the proper working of the Site;
- Taking any action that imposes an unreasonable or disproportionately large load on our infrastructure or that of our third-party providers.
4.3 Content Prohibitions
- Posting or transmitting any content that is defamatory, obscene, indecent, abusive, offensive, harassing, violent, hateful, inflammatory, or otherwise objectionable;
- Submitting false reviews, ratings, or testimonials regarding our products, services, or staff;
- Infringing upon any intellectual property rights, privacy rights, or other rights of any third party.
Violation of any of the above prohibitions may result in immediate termination of your account and access to our Services, and may subject you to civil and/or criminal liability.
5. Payment Terms and Order Processing
5.1 Pricing and Taxes
All prices displayed on the Site are in United States Dollars (USD) and are subject to change without notice. Applicable sales taxes, delivery fees, service charges, and other applicable fees will be calculated and displayed at checkout prior to finalizing your order. You are responsible for paying all applicable taxes and fees associated with your order.
5.2 Payment Methods
We accept major credit and debit cards, including Visa, MasterCard, American Express, and Discover, as well as any other payment methods specifically indicated on the Site at the time of your order. By providing payment information, you represent and warrant that: (a) the information is accurate and complete; (b) you are authorized to use the payment method provided; and (c) you authorize us to charge the total order amount to your designated payment method.
5.3 Order Confirmation and Processing
Receipt of your order confirmation does not constitute acceptance of your order. We reserve the right to accept or decline your order for any reason, including but not limited to unavailability of menu items, errors in pricing or product descriptions, or suspected fraudulent activity. If your order is declined after payment has been processed, we will promptly issue a full refund to your original payment method.
5.4 Refunds and Cancellations
Refund and cancellation policies are subject to our discretion based on the specific circumstances of each order. Orders that have already been prepared or are in the process of preparation may not be eligible for cancellation or refund. If you experience a problem with your order, please contact us as soon as possible at [email protected]. We will evaluate each request on a case-by-case basis and, where warranted, may offer a refund, store credit, or replacement item.
5.5 Delivery Terms
Estimated delivery times are provided as approximations only and are not guaranteed. Delivery availability is subject to geographic restrictions, weather conditions, driver availability, and other factors beyond our control. We are not responsible for delays caused by circumstances outside of our reasonable control.
6. Intellectual Property Rights
The Site and all of its contents, features, and functionality — including but not limited to all text, graphics, logos, images, photographs, audio and video clips, digital downloads, data compilations, software, and the selection, arrangement, and coordination thereof — are owned by Dewey's Pizza, its licensors, or other content providers and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.
The Dewey's Pizza name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of Dewey's Pizza or its affiliates. You may not use such marks without our prior written permission. All other names, logos, product and service names, designs, and slogans on the Site are the trademarks of their respective owners.
You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Site and its content solely for your personal, non-commercial purposes in connection with your use of our Services. This license does not include:
- Any resale or commercial use of the Site or its content;
- Any collection and use of any product listings, descriptions, or prices;
- Any derivative use of the Site or its content;
- Any downloading or copying of account information for the benefit of another merchant;
- Any use of data mining, robots, or similar data gathering and extraction tools.
Any unauthorized use of the Site or its contents terminates the license granted herein. We reserve all rights not expressly granted in and to the Site and its contents.
7. Food Safety, Allergen, and Nutritional Information
Dewey's Pizza takes food safety seriously and endeavors to comply with all applicable federal and state food safety regulations, including those established by the U.S. Food and Drug Administration (FDA) and applicable state health departments.
While we make reasonable efforts to provide accurate allergen and nutritional information, we cannot guarantee that our products are free from cross-contamination with allergens, including but not limited to gluten, nuts, dairy, eggs, soy, shellfish, or other common allergens. Our food is prepared in a kitchen environment that handles a wide variety of ingredients.
8. Disclaimers and "As-Is" Basis
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE SITE AND ALL SERVICES, CONTENT, AND PRODUCTS PROVIDED BY DEWEY'S PIZZA ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.
DEWEY'S PIZZA EXPRESSLY DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:
- IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT;
- WARRANTIES ARISING FROM A COURSE OF DEALING, USAGE, OR TRADE PRACTICE;
- WARRANTIES THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS;
- WARRANTIES AS TO THE ACCURACY, RELIABILITY, COMPLETENESS, OR TIMELINESS OF ANY CONTENT ON THE SITE;
- WARRANTIES REGARDING THE RESULTS THAT MAY BE OBTAINED FROM THE USE OF THE SITE OR SERVICES.
Some jurisdictions do not allow the exclusion of certain warranties, so some of the above exclusions may not apply to you. In such cases, our warranties will be limited to the minimum extent permitted by applicable law.
9. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL DEWEY'S PIZZA, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, SUPPLIERS, LICENSORS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO:
- LOSS OF PROFITS, REVENUE, DATA, OR BUSINESS OPPORTUNITIES;
- PERSONAL INJURY OR PROPERTY DAMAGE RELATED TO YOUR USE OF THE SITE OR SERVICES;
- UNAUTHORIZED ACCESS TO OR USE OF OUR SERVERS OR ANY PERSONAL INFORMATION STORED THEREIN;
- INTERRUPTION OR CESSATION OF TRANSMISSION TO OR FROM THE SITE;
- BUGS, VIRUSES, TROJAN HORSES, OR SIMILAR HARMFUL CODE TRANSMITTED THROUGH THE SITE;
- ERRORS OR OMISSIONS IN ANY CONTENT ON THE SITE;
- ANY LOSS OR DAMAGE INCURRED AS A RESULT OF YOUR USE OF ANY CONTENT OR SERVICES AVAILABLE THROUGH THE SITE.
IN NO EVENT SHALL DEWEY'S PIZZA'S TOTAL CUMULATIVE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR YOUR USE OF THE SITE OR SERVICES EXCEED THE GREATER OF: (A) THE TOTAL AMOUNT PAID BY YOU TO DEWEY'S PIZZA IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM; OR (B) ONE HUNDRED DOLLARS ($100.00 USD).
The limitations set forth in this section shall apply regardless of the form of action, whether in contract, tort (including negligence), strict liability, or otherwise, and regardless of whether Dewey's Pizza has been advised of the possibility of such damages. Some jurisdictions do not allow the limitation of liability for personal injury or incidental or consequential damages, so certain limitations above may not apply to you.
10. Indemnification
You agree to defend, indemnify, and hold harmless Dewey's Pizza, its parent companies, subsidiaries, affiliates, officers, directors, shareholders, employees, agents, contractors, licensors, service providers, subcontractors, suppliers, and successors from and against any and all claims, liabilities, damages, judgments, awards, losses, costs, expenses, and fees (including reasonable attorneys' fees) arising out of or relating to:
- Your violation of these Terms or any applicable law or regulation;
- Your use of the Site or Services in any manner not expressly authorized by these Terms;
- Your User Content or submissions to the Site;
- Your violation of any rights of a third party, including intellectual property rights, privacy rights, or publicity rights;
- Any misrepresentation made by you;
- Your negligence or willful misconduct.
We reserve the right, at our own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which case you shall cooperate with us in asserting any available defenses.
11. Third-Party Links and Services
The Site may contain links to third-party websites, applications, or services that are not owned or controlled by Dewey's Pizza. We have no control over, and assume no responsibility for, the content, privacy policies, terms of service, or practices of any third-party websites or services. We do not warrant or make any representations regarding the accuracy, quality, or reliability of any third-party content or services.
We encourage you to review the terms and privacy policies of any third-party websites you visit. We may use third-party service providers for payment processing, delivery logistics, analytics, marketing, and other operational functions. Your interactions with such third parties are governed by their respective terms and policies.
Acknowledgment of any third-party link or service on our Site does not constitute or imply our endorsement, sponsorship, or recommendation of that third party or the products and services they offer.
12. Governing Law and Jurisdiction
These Terms of Service shall be governed by and construed in accordance with the laws of the United States of America and the laws of the state applicable to the business operations of Dewey's Pizza, without giving effect to any choice of law or conflict of law provisions. The Federal Arbitration Act (9 U.S.C. §§ 1 et seq.) shall govern the arbitration provisions set forth in Section 13.
To the extent that any dispute is not subject to arbitration as set forth herein, you consent to the exclusive personal jurisdiction of and venue in the state and federal courts located in the United States having jurisdiction over the matter, and you waive any objection to the laying of venue of any such proceeding in such courts.
These Terms shall also be subject to applicable federal consumer protection laws enforced by the Federal Trade Commission (FTC) under the FTC Act (15 U.S.C. §§ 41 et seq.), as well as any other applicable federal or state consumer protection statutes. Users located in California may also have additional rights under the California Consumer Privacy Act (CCPA) and the California Privacy Rights Act (CPRA), as more fully described in our Privacy Policy.
13. Dispute Resolution and Arbitration
13.1 Informal Resolution
Before initiating any formal legal proceeding, you agree to first attempt to resolve any dispute, claim, or controversy arising out of or relating to these Terms or your use of the Site and Services informally. You must contact us at [email protected] with a written description of your claim, and we agree to use reasonable efforts to resolve the dispute informally within thirty (30) days of receiving your notice.
13.2 Binding Arbitration
If we are unable to resolve a dispute informally within thirty (30) days, any and all disputes, claims, or controversies arising out of or relating to these Terms, the Site, or the Services — including questions about their existence, validity, interpretation, breach, or termination — shall be resolved exclusively by binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules in effect at the time of the arbitration, except as modified herein. The arbitrator's decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.
13.3 Class Action Waiver
13.4 Exceptions to Arbitration
Notwithstanding the foregoing, either party may seek emergency injunctive or other equitable relief from a court of competent jurisdiction to prevent actual or threatened infringement, misappropriation, or violation of intellectual property rights, confidentiality obligations, or other proprietary rights. Additionally, small claims court actions that qualify under applicable small claims court rules may be brought in lieu of arbitration.
13.5 Arbitration Costs
The costs of arbitration shall be allocated in accordance with the AAA Consumer Arbitration Rules. For claims of $10,000 or less, Dewey's Pizza will pay all arbitration costs unless the arbitrator finds your claim to be frivolous. For claims exceeding $10,000, the allocation of arbitration costs shall be governed by the AAA rules.
14. Term and Termination
These Terms shall remain in full force and effect for as long as you access or use the Site or Services. We reserve the right, in our sole discretion, to:
- Terminate or suspend your access to all or any part of the Site or Services at any time, with or without cause, with or without notice, effective immediately;
- Deactivate or delete your account and all associated information and files in your account;
- Refuse service to any person or entity for any reason or no reason.
You may terminate your account at any time by contacting us at [email protected] and requesting account deletion. Termination of your account does not relieve you of any obligations incurred prior to termination, including payment obligations for completed orders.
Upon termination for any reason, all rights and licenses granted to you under these Terms shall immediately cease. Sections of these Terms that by their nature should survive termination — including but not limited to intellectual property rights, disclaimers, limitation of liability, indemnification, dispute resolution, and governing law — shall survive termination.
15. Changes to Terms
We reserve the right to modify, amend, or update these Terms of Service at any time at our sole discretion. When we make material changes to these Terms, we will provide notice by:
- Posting the revised Terms on this page with an updated "Last Updated" date;
- Sending an email notification to the address associated with your account (if applicable); and/or
- Displaying a prominent notice on the Site.
Your continued use of the Site or Services after any changes to these Terms become effective constitutes your acceptance of the revised Terms. If you do not agree to the modified Terms, you must stop using the Site and Services immediately and, if applicable, close your account. 16. Severability
If any provision of these Terms of Service is found by a court, arbitrator, or other tribunal of competent jurisdiction to be invalid, illegal, void, or unenforceable under applicable law, such provision shall be deemed modified to the minimum extent necessary to make it valid, legal, and enforceable, or if it cannot be so modified, it shall be severed from these Terms. The validity, legality, and enforceability of the remaining provisions of these Terms shall not in any way be affected or impaired thereby, and such provisions shall continue in full force and effect.
The failure of Dewey's Pizza to enforce any right or provision of these Terms shall not be deemed a waiver of such right or provision. A waiver by Dewey's Pizza of any breach or default under these Terms shall not constitute a waiver of any subsequent breach or default.
17. Entire Agreement
These Terms of Service, together with our Privacy Policy and any other legal notices, policies, or agreements published by us on the Site, constitute the entire agreement between you and Dewey's Pizza with respect to your use of the Site and Services, and supersede all prior and contemporaneous understandings, agreements, representations, and warranties, both written and oral, regarding the same subject matter.
No oral or written information or advice given by Dewey's Pizza, its employees, agents, or representatives shall create any additional warranty or in any way increase the scope of the warranties expressly disclaimed in these Terms. Any ambiguities in the interpretation of these Terms shall not be construed against the drafting party.
18. Force Majeure
Dewey's Pizza shall not be liable for any failure or delay in performance under these Terms arising out of causes beyond its reasonable control, including but not limited to acts of God, natural disasters, pandemics, epidemics, fire, floods, earthquakes, wars, acts of terrorism, government actions, labor disputes, strikes, power outages, internet or telecommunications failures, or supply chain disruptions. In the event of a force majeure event, we will use commercially reasonable efforts to resume operations as soon as practicable and will notify affected customers as appropriate.
19. Electronic Communications and Consent
By using the Site, creating an account, or placing an order, you consent to receive electronic communications from Dewey's Pizza. These communications may include emails, text messages (if you have provided your mobile number and opted in), and notices posted on the Site regarding your account, orders, promotions, or updates to our policies. You agree that all agreements, notices, disclosures, and other communications we provide to you electronically satisfy any legal requirement that such communications be in writing.
